A trademark is a word, design, or combination of the two that a manufacturer or merchant uses to identify its goods and distinguish them from others' goods. A service mark is a word, a design, or a combination of the two used by a merchant to identify services and to distinguish them from others' services.

Trademarks and service marks may be registered under California law. This procedure is significantly less formal and less thorough than the federal registration process; it is also significantly less valuable.

It is generally better to seek federal protection if they engage in interstate commerce. Federal registration affords the owner greater rights than does state registration, provides nationwide notice of the owner's prior rights, and, despite the greater expense and complexity of the application process, is ultimately far more valuable than state registration.
